General terms and conditions
The following terms and conditions apply to all contracts, deliveries and other services of ecofort ag (operator of ecofort.ch, gtech.ecofort.ch, luftentfeuchter-shop.ch and infrarotheizung-shop.ch). We hereby expressly oppose differing rules of the contractor. Special agreements are only binding if they have been confirmed in writing.
The ordered items are shipped by Swiss Post.
Generally the ordered products will be delivered against prepayment. Shipping on account can only be offered after a successful credit check. The shipping is free from a shopping cart value of CHF 49.- or more. For a shopping cart value of less than CHF 49.-, a small handling & shipping fee of CHF 9.- will apply.
The delivery times can be found on the corresponding product pages next to the shopping cart.
If the delivery time is not adhered to, the purchaser is entitled to set a reasonable grace period in writing (e-mail or letter) with a threat of rejection and to withdraw from the order after its expiration. Exception: customer-specific custom-made products.
If the delay in delivery is caused by the inability of the manufacturer or our supplier to supply the products, both ecofort ag and the buyer can withdraw from the order, if the agreed delivery date is exceeded by more than 30 days.
Claims for damages due to delayed delivery or impossibility or non-fulfillment of the contract, including those that have arisen until the order is withdrawn, are excluded, unless a legal representative of ecofort ag has demonstrably acted intentionally or in a grossly negligent manner.
3. Technical specifications
All technical specifications and data are based on the information provided by the manufacturers and / or external testing bodies and / or their own measurements. Such technical data are no assurances of ecofort ag for specific product characteristics. For any printing and transmission errors no liability is accepted.
The prices are in Swiss Francs (CHF), including VAT (VAT), plus shipping costs for transport, packaging and insurance. Price errors and changes are reserved. The price valid on the day of order applies.
The following payment options as prepayment are open to all customers: E-banking (bank transfer), Visa, Mastercard and PayPal.
Purchase on account: The purchase on account requires a credit check. If the credit check is negative, prepayment is required.
The payment period is 30 days from date of invoice.
In the event of late payment after two written reminders, the claim will be assigned to our collection partner. Further additional fees will be charged according to www.fairpay.ch.
6. Retention of ownership
The delivered products remain the property of ecofort ag until full payment of the outstanding invoice amount.
7. Complaints and returns
Complaints and damages in transit must be reported to ecofort ag immediately upon receipt of the goods, but no later than 24 hours after delivery. Otherwise, the delivery is considered as accepted. The transport insurance only covers transport damages, which are reported within 24 hours.
If a product does not meet your expectations and you wish to return the goods, we ask you to contact our customer service before returning the product.
The following conditions apply:
Products that were available on stock in our own warehouse and are still in undamaged original packaging, can usually be returned. However, please understand that we can no longer or only accept returns for which we have ordered specially for you or products that are not in perfect condition or have incomplete or damaged packaging, or only for a turnover fee.
Returns must be reported in writing by e-mail before returning the products back to ecofort ag. Legitimate reasons for the return are wrong delivery, too many products delivered and defective goods.
Unlimited right to return - return possible
Current daily price (maximum purchase price) + deduction of transport costs.

- The right of return excludes consumables (replacement filters, batteries, etc.). These items can not be returned.
Conditional right of return - return with 10% deduction possible
10% deduction from the current daily price (maximum purchase price) + deduction of transport costs.

- All accessories that come with the product are in the box
- The product hasn't been used and has no signs of use
- Within 14 days of your order
Conditional right to return - decision after individual examination of the product
At least 20% deduction from the current daily price + deduction for transport costs.

- A return takes place after examination by our technicians and can not be guaranteed
- The amount of the discount will be determined after the examination by our technicians

- Missing accessories

- In case of poor maintenance / cleaning
- The purchase of the product is more than 14 days ago
All warranty claims must be reported in writing using the contact form on our website, email or by letter. For reference, the order number (on the invoice issued) must be indicated.
Defective products are usually not picked up, unless explicitly mentioned on the product page (pick-up guarantee). The customer must send the defective device at his own expense and risk to the designated service point or deliver it to the specified location. The products must be returned with all the accessories in the original packaging accompanied by the sales receipt, stating the supplier's return code or in the showroom. If the original packaging is missing, the device is ready for transport.
The warranty period is usually 2 years if not stated otherwise on the respective product page. The warranty period starts from the date on the invoice. The invoice is considered a guarantee certificate. Excluded from the warranty are damage resulting from modifications or repairs by the customer, as well as wear and tear, force majeure and non-observance of operating instructions and improper handling.
In the case of a faulty product, these will be - at our discretion - either replaced or repaired free of charge by new, faultless product. The right to change and reduction is excluded. Further claims are excluded. Our advice is given to the best of our knowledge, but without guarantee. The customer has no claims against ecofort ag with regard to losses and damages caused by the freight forwarder.
The customer is responsible for the selection and use of the products. Claims for damages of any kind are excluded unless ecofort ag has caused the damage intentionally or through gross negligence. No liabilty for consequential or indirect damages.
The business activities of ecofort ag are based exclusively on Swiss law. Place of fulfillment and jurisdiction is Nidau (canton Bern).
